Divorce is hard on its own. When there is a house, the money side gets harder. This guide explains your mortgage options in Niagara, how a spousal buyout works, and how a Certified Divorce Specialist (CDS) can help you plan your next step.
What is a divorce mortgage?
It is any mortgage you need because a marriage or common-law relationship has ended. That can mean:
- Buying out your spouse so you can keep the home
- Refinancing to take your ex off the title
- Qualifying for a new home on one income
- Getting a mortgage while you rebuild credit that took a hit
The basic rules are the same as any mortgage. The difference is how lenders look at support payments, your separation agreement and your new single income.

What is a spousal buyout mortgage?
A spousal buyout lets one spouse borrow up to 95% of the home’s appraised value to pay the other spouse their share of the equity. A normal refinance stops at 80%. Under the insured spousal buyout programs, the buyout is treated more like a purchase, which is why the limit is higher.
To qualify, you usually need:
- A signed separation agreement that states the buyout amount
- An appraisal of the home
- Enough income to carry the new payment on your own
- A credit score that meets the lender’s minimum, often 620 or higher

How does support affect my mortgage?
If you pay spousal or child support, the lender counts it as a monthly cost. That lowers how much you can borrow.
If you receive support, it can count as income. Most lenders want to see about three months of payments received and proof that support will continue for at least three more years.
A broker who works on divorce mortgages knows how to show these payments the right way so your application has the best chance.
Common situations in Niagara
You want to keep the home
You need a mortgage big enough to pay your spouse their share and take them off the title. The big question is whether your income alone can carry the payment. We run the numbers first, before any credit check, so you know where you stand.
Neither of you can afford it alone
Selling is often the simplest answer. Some couples keep the home together for a while and live apart, then sell when the market or their finances improve.
You want to buy a new home
Many people want a new place quickly so the family has stability. You qualify on your own income after support. If your credit took damage during the split, an alternative lender can help while you rebuild.
Why work with a Certified Divorce Specialist?
A CDS has extra training in the money and tax side of separation. That means knowing how to work with your lawyer or mediator, how to build an application around a separation agreement, and how to take things at a pace that works for you.

Common questions
Can I get a mortgage if my credit was damaged during the separation?
Yes. Alternative and private lenders work with bruised credit. These are usually short-term loans that give you 12 to 24 months to rebuild before moving to a bank at a better rate.
Do I need a separation agreement before I apply?
For a spousal buyout, yes. Lenders need a signed agreement that shows the buyout amount and all support. For a new purchase, a signed agreement is still strongly recommended so your income and payments are clear.
How long does a spousal buyout take in Niagara?
With the appraisal, separation agreement and income documents ready, approval can come in 48 to 72 hours. The legal title transfer usually takes two to four weeks, depending on your lawyer.
How much can I borrow for a spousal buyout?
Up to 95% of the home’s appraised value under the insured spousal buyout programs, if your income supports the payment. A regular refinance is capped at 80%.
