Book a Confidential CallLet’s look at your options
Keep the home
If staying matters to you, we’ll explore whether a spousal buyout is possible and what the payments would mean for your budget. The goal is to understand both what you could qualify for and what you can comfortably manage.
Sell and plan your next move
Before you commit to selling, we can assess what you may qualify for on your own, so you know where you stand before you list.
Access equity for a settlement payment
If your separation agreement includes an equalization payment, we’ll review whether a spousal buyout mortgage or refinance could help fund it, working alongside your lawyer so the financing reflects the agreement.
Continue owning together for now
An immediate sale or buyout may not be your next step. We’ll explain how remaining on the mortgage could affect your borrowing options and help you identify questions to work through with your lawyer.
You don’t need to have everything figured out before we talk. Book a confidential call, and we’ll start with where you are.

Common questions
Separation and divorce questions
Can I keep my home after separation in Ontario?
Possibly. Separation doesn’t automatically mean you have to sell. We’ll look at your income, debts, credit, the home’s value and any amount needed to buy out your former partner. There is often more room than people expect, through a longer amortization, a co-signer or support payments counted as income.
Just as importantly, we’ll look at what the payments would mean for your everyday life. Qualifying for the mortgage is one part. Having enough breathing room afterwards matters too.
What is a spousal buyout mortgage in Ontario?
A spousal buyout mortgage can help one owner purchase the other owner’s share of the home. Depending on the transaction, it may provide financing to pay out the existing mortgage and fund the agreed buyout.
We’ll review the financing options and work with your lawyer to coordinate the mortgage with the ownership transfer.
Can I borrow up to 95% of my home’s value for a spousal buyout?
In some eligible cases, yes. Mortgage insurers allow spousal buyout financing up to 95% of the home’s value, subject to lender and insurer approval. A standard refinance stops at 80%.
Both of you must already be on title, and the transaction needs acceptable documentation, such as a finalized separation agreement, purchase agreement or court order. You still need to qualify for the mortgage. Having equity or a signed agreement doesn’t guarantee approval.
Do I need a separation agreement before I can get a spousal buyout?
Yes. Lenders want a signed, finalized agreement that states the buyout amount and confirms both of you agree to the transfer.
Should I speak with a mortgage broker before signing my separation agreement?
Yes, particularly if the agreement depends on one person keeping the home or borrowing to make a payment. How the buyout is worded can change how much you qualify for, and once it is signed it is much harder to fix.
We can assess the proposed financing before you commit to it. Your lawyer handles the legal agreement; we help you understand whether the mortgage plan behind it is workable.
Does child or spousal support count as income for a mortgage?
It may. Lenders can consider eligible support income, but they need to see how it is documented, whether payments are being received and how long they are expected to continue. Most want three to twelve months of consistent payments landing in your account, so when you apply matters as much as what the agreement says.
We’ll review your agreement and payment history, then confirm what the lender can use. Support you pay also affects your borrowing capacity.
If I move out, am I still responsible for the mortgage?
Moving out does not remove your responsibility as a borrower. If you remain on the mortgage, the lender can still require you to repay the debt, even if your former partner is making the payments. That debt also counts against you when you apply for your next mortgage.
Getting your name off is a separate step from the separation agreement, and it is the one people most often assume has happened when it has not. Before making another housing commitment, confirm your obligations and any arrangements for release with your lender and lawyer.
Can I use home equity to fund an equalization payment?
Potentially. We can assess whether a refinance or an eligible buyout transaction could provide the funds required under your agreement.
The right approach depends on the payment’s purpose, available equity and your ability to qualify. Your lawyer determines your legal obligations; we assess the financing options.
Will a separation hurt my credit or my ability to get a mortgage?
The separation itself does not touch your credit. Joint debts and missed payments during the transition can, and that is where the damage usually happens, because both names stay attached while everything else is being sorted out.
Separating the finances cleanly, and in the right order, is a large part of what we do on these files.
What if I can’t qualify to keep the home right now?
That’s information we can build a plan around, not a reason to feel embarrassed.
We’ll explain what is limiting the application and explore whether a different mortgage option, a qualified co-borrower, debt reduction or more time could help. We’ll also be honest if selling or renting would give you more financial stability.
What is a Certified Divorce Specialist (CDS®)?
A Certified Divorce Specialist is a professional who has completed additional training in working with people going through divorce.
The program covers communication skills and foundational knowledge of the legal, financial, housing and mental health aspects of divorce. It helps professionals understand how these issues connect and when collaboration with other professionals is needed.
How does Kelly Foote’s CDS® training help me?
Kelly Foote is a Certified Divorce Specialist and, as of August 2026, the only mortgage broker in Niagara who holds the designation. She combines her mortgage expertise with additional training in communicating with and supporting people through separation.
For you, that means space to ask questions, clear explanations and a mortgage conversation that considers the practical decisions and emotional pressure you may be facing. You don’t need to arrive with everything figured out.
Does the CDS® designation mean Kelly Foote provides legal or tax advice?
No. The designation adds divorce-specific training to her work as a mortgage broker. It does not qualify her to practise family law, provide tax advice or offer therapy.
Her role is to help you understand and arrange mortgage financing, working alongside your lawyer, accountant and other professionals where needed.
Let’s start with a conversation.
Thirty minutes. No pressure. No rate-shopping. We listen, we ask questions, and we tell you whether the mortgage you are thinking about is actually a win for your future.
Typical 24h-48h turnaround time for a fully underwritten pre-approval.
